How much time do I have after a foreclosure notice in Georgia?
Georgia foreclosures usually happen without a court case. The lender must send a notice of the sale at least 30 days before it and advertise it in the county's legal newspaper in the weeks before the sale. Sales are held on the first Tuesday of the month at the county courthouse, or the Wednesday after when that Tuesday is a holiday.
Most homeowners reach us about two weeks before their sale date. That is still workable, but the first job becomes getting the sale postponed, so call as soon as you have a date.
What should I do first?
- Find your sale date. It is on the notice from the lender or its attorney.
- Do not ignore mail from the lender or servicer. Open everything and keep it together.
- Gather your recent pay stubs, bank statements, tax returns and a short explanation of your hardship.
- Check whether your home is listed with another agent. If it is, work with that agent.
- Call us to talk through whether a short sale, a regular sale or another option fits.
Is a short sale my only option?
No. If you have equity, a regular sale may let you keep the difference. If the lender has offered a loan modification you can afford, that may be the better path. A short sale is for homeowners who owe more than the home is worth and cannot catch up. We will tell you if it is not the right tool.
Why do homeowners in Atlanta end up here?
In our experience the common thread is affordability. The payment stopped being affordable, whether from a lost job, illness, divorce or a payment that went up. The homes themselves vary widely, and every homeowner's situation is different.
